Terms of Service

Effective date: September 11, 2026

These Terms of Service ("Terms") govern access to and use of the bemyguest website, applications, digital guest guides, and related services (together, the "Service").

The Service is operated by MANDARINO, obrt za informatičke usluge, vl. Giorgio Nikolov, a obrt (a Croatian sole proprietorship / registered trade business) established in Croatia, with its registered address at Ulica Giuseppea Tartinija - Via Giuseppe Tartini 12, 52210 Rovinj-Rovigno, Croatia, registration number MBO (matični broj obrta) 99365219, and VAT or tax number HR97152348356 ("bemyguest", "we", "us", or "our").

By creating an account, purchasing a subscription, accessing the Service, or using a guest guide, you agree to these Terms. If you use the Service for an organisation or accommodation business, you confirm that you have authority to accept these Terms on its behalf.

1. About the Service

bemyguest enables accommodation operators to create and share browser-based digital guest guides. Depending on the features selected, a guide may include:

  • arrival directions, check-in details, parking information, and access instructions;
  • property information, Wi-Fi details, house rules, appliance guides, and photographs;
  • local recommendations, activities, events, and collections;
  • personalised guest names, stay dates, and welcome messages;
  • checkout information, departure checklists, and review prompts;
  • optional services offered by the accommodation operator;
  • AI-assisted content creation and a guest-facing assistant.

bemyguest is not a booking platform, channel manager, property-management system, emergency service, travel agency, or substitute for direct communication where urgent assistance is required.

2. Eligibility and account authority

You must be at least 18 years old and legally capable of entering into a contract to create an account or purchase a subscription.

The Service is designed primarily for professional and business use by accommodation operators. If you qualify as a consumer under applicable law, nothing in these Terms removes rights that cannot lawfully be excluded.

You must provide accurate account information and keep it up to date. You are responsible for:

  • protecting your login credentials;
  • activity performed through your account;
  • promptly notifying us of suspected unauthorised access;
  • ensuring that each person you invite to manage an account has appropriate authority.

You may not share an account in a way that bypasses plan limits or creates a security risk.

3. Customer responsibilities

You are responsible for the accuracy, legality, safety, and suitability of all information you publish through the Service.

You must ensure that:

  • property and arrival information is current and accurate;
  • access instructions and codes are shared only with appropriate guests;
  • local recommendations do not contain misleading, unlawful, or dangerous claims;
  • photographs, text, logos, and other content may lawfully be used;
  • you have an appropriate legal basis to provide guest personal data to the Service;
  • your use of review prompts complies with the rules of the relevant review platform;
  • your guest-facing guide complies with laws that apply to your accommodation activity.

You remain responsible for communicating urgent changes directly to guests. Do not rely solely on the Service for emergencies, safety warnings, last-minute access changes, or time-critical instructions.

4. Guest links and access information

Guest guides may be accessible to anyone who has the relevant link. A link should therefore be treated as confidential when it contains guest names, stay dates, property access details, door codes, keybox codes, or similar information.

You are responsible for deciding what information to include and for using any available expiry, regeneration, access-control, or deletion features appropriately.

You must not publish high-risk credentials in a permanent or broadly distributed guide. You should change or deactivate temporary access codes after the relevant stay whenever reasonably possible.

We do not guarantee that a recipient will keep a guest link confidential or that a third party will never obtain access through forwarding, copying, screenshots, browser history, compromised devices, or other circumstances outside our control.

5. Guest data and data protection roles

For personal data that you enter or upload about guests, you normally act as the data controller or business, and bemyguest normally acts as your processor or service provider.

You are responsible for:

  • giving guests any privacy information required by law;
  • having a valid legal basis for using guest data;
  • collecting only data that is relevant and necessary;
  • responding to guest privacy requests, with our reasonable assistance where required;
  • avoiding unnecessary sensitive personal data.

Our processing of guest data on your instructions is also subject to the Data Processing Addendum.

For account, website, security, support, and service-administration data that we determine how and why to use, we act as an independent controller. Further information is provided in our Privacy Policy.

6. Subscriptions, payment, and Paddle

Paid access is provided through recurring subscription plans shown on the pricing page or at checkout. Plan limits, features, billing periods, currencies, and prices may change from time to time, subject to applicable notice requirements.

Payments are processed by Paddle, which acts as the authorised reseller and Merchant of Record for transactions. When you purchase a subscription:

  • you purchase the subscription transaction from the relevant Paddle entity;
  • Paddle charges the payment method, calculates applicable transaction taxes, and issues payment documents;
  • Paddle's Buyer Terms and Paddle's Refund Policy apply to the purchase transaction;
  • these Terms apply between you and MANDARINO, obrt za informatičke usluge, vl. Giorgio Nikolov and govern your use of the Service.

If there is a conflict concerning payment processing, tax, cancellation of the transaction, statutory withdrawal, or refund administration, Paddle's applicable buyer terms govern to the extent of that conflict.

We do not receive or store your complete payment-card details. We may receive billing-related information from Paddle, such as your name, email address, country, plan, transaction identifier, subscription status, and payment status.

7. Free trials

A subscription may include a 14-day free trial. The checkout page will state:

  • whether a payment method is required;
  • when the first charge will occur;
  • whether the subscription will begin automatically when the trial ends;
  • how to cancel before being charged.

If the trial converts automatically, you must cancel before the trial ends to avoid the first charge. Creating multiple accounts or using misleading information to obtain repeated trials is prohibited.

We may modify or withdraw trial offers for future sign-ups. This does not affect an active trial unless permitted by law and clearly communicated.

8. Renewal and cancellation

Unless the checkout states otherwise, paid subscriptions renew automatically for a period equal to the previous subscription term until cancelled.

You may cancel through the Paddle buyer portal, the link in your Paddle confirmation email, or by contacting hello@bemyguest.link.

Cancellation normally takes effect at the end of the current paid billing period. You may continue using the paid Service until that date unless:

  • a refund is issued and access is withdrawn;
  • the account is terminated for breach;
  • continued access would create a security, legal, or operational risk.

Cancellation stops future renewal charges. It does not automatically create a right to a refund for the current billing period. Refunds are addressed in the Refund Policy.

9. Licence to use the Service

Subject to these Terms and payment of applicable charges, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Service for your internal accommodation business purposes during your subscription.

You may share guest-facing guides with guests and prospective guests as intended by the Service.

You may not:

  • copy, resell, rent, sublicense, or commercially redistribute the Service;
  • reverse engineer, decompile, or attempt to obtain source code except where the law expressly permits it;
  • access the Service to build or benchmark a competing product;
  • circumvent usage limits, security controls, or subscription restrictions;
  • use automated tools to scrape or extract data except through an authorised interface;
  • remove copyright, trademark, or proprietary notices.

10. Your content

You retain ownership of content you submit to the Service, including property information, photographs, instructions, recommendations, and welcome messages ("Customer Content").

You grant us and our service providers a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit, format, display, and otherwise use Customer Content only as reasonably necessary to:

  • provide and secure the Service;
  • display guides to your authorised recipients;
  • provide support;
  • comply with law;
  • improve the Service using aggregated or de-identified information.

You confirm that you have all rights and permissions necessary to submit Customer Content and allow us to process it under these Terms.

We do not claim ownership of Customer Content.

11. AI-assisted features

The Service may use artificial intelligence to draft descriptions, organise information, suggest local places, or answer guest questions from guide content.

AI output may be incomplete, inaccurate, outdated, misleading, or unsuitable. You must review and verify AI-generated content before publishing or relying on it, especially content involving:

  • property access;
  • safety;
  • transport;
  • opening hours;
  • prices;
  • allergens;
  • medical needs;
  • local laws;
  • emergency information.

AI features do not replace your judgment or responsibility. You must not submit unnecessary sensitive, confidential, or high-risk personal data to an AI feature.

We may use third-party AI providers to process prompts and relevant guide content. The Privacy Policy explains the categories of providers and data involved.

12. Local recommendations and third-party information

Recommendations, maps, place details, activities, events, transport information, and external links may come from you, public sources, or third-party providers.

We do not guarantee that third-party information is accurate, available, safe, lawful, accessible, or suitable for a particular guest. Opening hours, prices, routes, conditions, and availability may change without notice.

Guests should confirm important information directly with the relevant venue or provider. Any booking, purchase, visit, or interaction with a third party is between the guest and that third party.

13. Optional services offered by customers

The Service may allow you to display optional services such as transfers, breakfast, cleaning, or other extras.

Unless a checkout expressly identifies bemyguest or Paddle as the seller of a specific extra:

  • the service is offered by you or the identified third party;
  • you are responsible for its description, price, taxes, fulfilment, cancellation, and legal compliance;
  • any agreement is between you and the guest;
  • we are not responsible for delivery, quality, injury, loss, or disputes relating to that service.

14. Acceptable use

You may not use the Service to:

  • break any law or facilitate unlawful activity;
  • infringe intellectual-property, privacy, publicity, consumer, or other rights;
  • upload malware, harmful code, or deceptive links;
  • harass, discriminate against, threaten, or exploit another person;
  • publish fraudulent, misleading, or materially inaccurate accommodation information;
  • collect or expose personal data without a lawful basis;
  • publish passwords, payment-card data, government identification numbers, health data, or other sensitive information unless strictly necessary, lawful, and appropriately protected;
  • manipulate, fabricate, buy, or unlawfully incentivise reviews;
  • send spam or unsolicited communications;
  • interfere with the Service or another user's access;
  • test security vulnerabilities without written permission;
  • impersonate another person or misrepresent your authority.

We may investigate suspected misuse and remove content, restrict sharing, suspend access, or terminate an account where reasonably necessary.

15. Intellectual property

The Service, software, brand, visual design, documentation, templates, and all related intellectual-property rights, excluding Customer Content, belong to MANDARINO, obrt za informatičke usluge, vl. Giorgio Nikolov or its licensors.

"bemyguest" and related marks may not be used without prior written permission, except to accurately identify the Service.

If you provide ideas, suggestions, or feedback, you grant us a perpetual, worldwide, irrevocable, royalty-free right to use them without restriction or compensation, provided we do not identify you publicly without permission.

16. Third-party services

The Service relies on third-party providers for hosting, databases, authentication, email, payments, analytics, maps, place information, AI, and other functions.

Third-party services may be governed by their own terms and privacy notices. We are not responsible for a third-party service outside our control, but this does not limit obligations we cannot lawfully exclude.

We may replace a third-party provider where reasonably necessary to operate, secure, or improve the Service.

17. Availability, maintenance, and changes

We aim to keep the Service available, but do not promise uninterrupted or error-free operation unless a separate written service-level agreement says otherwise.

We may:

  • perform maintenance;
  • fix security issues;
  • add, change, or remove features;
  • impose reasonable technical limits;
  • discontinue part or all of the Service.

Where a material change negatively affects a paid subscription, we will provide reasonable notice where practicable and any remedy required by law.

You are responsible for keeping copies of information you cannot afford to lose. Before account closure, export available data where the Service provides an export function.

18. Support

Support is available through hello@bemyguest.link.

Any stated response time is an estimate unless a separate written support agreement expressly guarantees it.

We may request information reasonably necessary to investigate an issue, confirm account ownership, or protect the Service.

19. Suspension and termination

You may stop using the Service at any time and may cancel a subscription as described above.

We may suspend or terminate access if:

  • you materially or repeatedly breach these Terms;
  • charges remain unpaid;
  • your use creates a security, legal, or reputational risk;
  • we reasonably suspect fraud, abuse, or unauthorised access;
  • a competent authority or payment provider requires us to act;
  • continuing the Service is no longer commercially or technically feasible.

Where reasonable and legally permitted, we will give notice and an opportunity to correct a remediable breach.

After termination, your right to use the Service ends. We may delete account data according to the Privacy Policy, subject to legal retention duties and a reasonable export period where applicable.

Sections that by their nature should survive termination remain in effect, including ownership, payment obligations, disclaimers, liability limits, indemnity, and dispute terms.

20. Disclaimer of warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available."

We do not warrant that:

  • the Service will be uninterrupted, secure, or error free;
  • all content or third-party information will be accurate or current;
  • the Service will meet every legal requirement applicable to your accommodation;
  • use of the Service will produce more bookings, revenue, reviews, or guest satisfaction;
  • AI output will be correct or suitable.

Nothing in these Terms excludes warranties, guarantees, or remedies that cannot lawfully be excluded.

21. Limitation of liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, wilful misconduct, or death or personal injury caused by negligence where such liability cannot be excluded.

To the maximum extent permitted by law:

  • neither party is liable for indirect, incidental, special, exemplary, punitive, or consequential loss;
  • we are not liable for loss of profits, revenue, bookings, business opportunity, reputation, data, or anticipated savings;
  • we are not liable for acts or omissions of guests, venues, service providers, payment providers, or other third parties;
  • our total aggregate liability arising from the Service during any 12-month period will not exceed the greater of (a) the amount paid for the Service during the 12 months before the event giving rise to the claim, or (b) USD 100.

These limitations apply regardless of the legal theory of liability and only to the extent permitted by applicable law.

22. Indemnity for business customers

If you use the Service in connection with a trade, business, craft, or profession, you will indemnify and hold MANDARINO, obrt za informatičke usluge, vl. Giorgio Nikolov harmless from third-party claims, losses, liabilities, and reasonable costs arising from:

  • Customer Content;
  • your accommodation operations;
  • your optional services;
  • your breach of these Terms;
  • your violation of law or third-party rights;
  • guest data you submit without appropriate authority or legal basis.

This section does not apply to a consumer where prohibited by law.

23. Confidentiality

Each party must protect non-public information received from the other that is clearly confidential or should reasonably be understood as confidential.

Confidential information may be used only for the relationship under these Terms and may be disclosed only to personnel, advisers, and service providers who need it and are subject to confidentiality duties, or where disclosure is required by law.

This section does not cover information that is public without breach, already lawfully known, independently developed, or lawfully received from another source.

24. Governing law and disputes

These Terms are governed by the laws of Croatia, without regard to conflict-of-law rules.

The courts located in Pazin, Croatia will have exclusive jurisdiction, unless mandatory law gives you the right to bring a claim elsewhere.

Before starting formal proceedings, each party should make a reasonable attempt to resolve the dispute by contacting hello@bemyguest.link and describing the issue.

If you are a consumer, this section does not remove mandatory protections or dispute rights available under the law of your usual country of residence.

25. Changes to these Terms

We may update these Terms to reflect changes to the Service, law, security practices, or business operations.

We will publish the updated version and change the effective date. If a change materially reduces your rights or materially affects a paid subscription, we will provide reasonable advance notice where required.

Continued use after the change becomes effective constitutes acceptance where permitted by law. If you do not agree, you must stop using the Service and cancel the subscription before the change takes effect.

26. Transfer of the agreement

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer these Terms to an affiliate, purchaser, successor, or newly established entity that continues operating bemyguest, provided that the transfer does not materially reduce mandatory rights. We will provide notice where required by law.

27. General terms

If part of these Terms is unenforceable, the remaining provisions remain in effect.

A delay in enforcing a right is not a waiver.

These Terms, the Privacy Policy, the Refund Policy, and any applicable Data Processing Addendum form the agreement concerning the Service, together with any order details presented at checkout.

Headings are for convenience only.
